Hereinafter referred to as “Seller.”
These terms and conditions apply to all offers, orders, and agreements made through the Seller’s webshop.
By placing an order, the Buyer agrees to these terms in full.
Any deviations from these terms are only valid if confirmed in writing by the Seller.
Article 2: Definitions
Buyer / Consumer: A natural person acting for purposes outside of their trade, business, or profession.
Distance Agreement: A contract concluded remotely, for example via the internet.
Products: All goods offered for sale on Orsha.nl.
Right of Withdrawal: The statutory right of a consumer to cancel a distance purchase within 14 days.
Article 3: Offers and Prices
All prices on the website include VAT and exclude shipping costs unless stated otherwise.
Obvious mistakes or typographical errors in prices or product information do not bind the Seller.
The Seller reserves the right to adjust prices and offers at any time.
An agreement is only concluded once the Seller confirms the order.
Article 4: Payment
Payment must be made immediately at the time of order using the available payment methods.
If a payment is refused, reversed, or charged back, the Seller reserves the right to:
Suspend delivery
Refuse future orders
Take collection measures
All costs arising from an unjustified chargeback will be charged to the Buyer.
Article 5: Order costs:
Order costs are never eligible for reimbursement.
Once these costs have been incurred, any form of refund or reversal is excluded.
Article 6: Delivery
The Seller aims to dispatch orders within 2–5 business days. (despatch time).
This is an indicative timeframe and not a strict deadline.
Delays in delivery do not entitle the Buyer to compensation.
The risk of loss or damage passes to the Buyer upon delivery.
If a product cannot be delivered, the amount paid will be refunded within 14 days.
Article 7: Right of Withdrawal
The Buyer may cancel the agreement within 14 days of receiving the product without giving any reason.
To exercise this right, the Buyer must contact the Seller at info@orsha.nl within 14 days of receipt.
Once notified, the Buyer has an additional 14 days to return the product.
Return shipping costs are the responsibility of the Buyer.
Products must be:
Unused
In their original condition
Returned in the original packaging
If the product has been used beyond what is necessary to inspect its nature, characteristics, and function, the Seller may charge a reasonable depreciation fee.
Article 8: Non-Returnable Products
For hygiene and health reasons, the following items cannot be returned, in accordance with Article 6:230p of the Dutch Civil Code:
Cups and pumps (all sizes)
Acupuncture pens
Silicone cups
Massage oils
Derma rollers
70% Alcohol
These items cannot be returned or refunded, whether the packaging has been opened or not. Returns of these products will be refused.
Article 9: Inspection Upon Receipt
The Buyer must inspect the products immediately upon receipt.
If a product is damaged or defective, it must be reported to the Seller in writing at info@orsha.nl within 7 days.
After this period, the products are deemed to have been received in good condition.
Article 10: Warranty
The Seller guarantees that products meet the agreement specifications.
Warranty does not apply if:
The product is used incorrectly
Instructions are not followed
The product is modified or altered
Damage results from improper use
The Seller may choose to repair or replace a defective product before issuing a refund.
Article 11: Medical and Health Disclaimer
Products sold on Orsha.nl are not medical devices unless explicitly stated.
Information on the website is for general guidance and does not replace medical advice from a doctor or specialist.
Use of products such as:
Derma rollers
Cups
Massage products
is entirely at the user’s own risk.
The Seller is not liable for physical injury, allergic reactions, or other health issues arising from product use.
In case of doubt, consult a medical professional before use.
Article 12: Liability
The Seller’s liability is limited to the purchase price of the relevant product.
The Seller is not liable for:
Indirect or consequential damages
Loss of profit
Bodily injury resulting from misuse
Damage caused by incorrect use of products
This limitation does not apply in cases of intent or gross negligence by the Seller.
Article 13: Retention of Title
All products remain the property of the Seller until full payment has been received.
If payment is not made, the Seller may reclaim the goods.
Article 14: Collection Costs
If the Buyer fails to meet payment obligations, statutory interest applies.
All extrajudicial collection costs are the responsibility of the Buyer in accordance with Dutch law.
Article 15: Privacy and Data Protection
The Seller processes personal data in compliance with the General Data Protection Regulation (GDPR).
Personal data are only used for:
Order processing
Product delivery
Customer service
Data will not be shared with third parties unless necessary to fulfill the agreement.
Article 16: Force Majeure
The Seller is not liable for delays or damages due to force majeure, including but not limited to:
Disruptions in transport services
Pandemics
Strikes
Technical failures
Government measures
In such cases, the Seller may suspend or terminate the agreement.
Article 17: Governing Law and Disputes
All agreements are governed by Dutch law.
Disputes will be submitted to the competent court in the Netherlands.
Consumers within the EU may also use the ODR platform for online dispute resolution.
